DREAMDIGITAL.AI LIMITED provides a platform for digital AI-based tools, including but not limited to AI character creation, voice synthesis, and large language model interactions.

• AI Nature: You acknowledge that the Service utilizes experimental artificial intelligence. Outputs may be inaccurate, offensive, or biased. You should independently verify any information generated.
• Evolution of Service: We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts and Security

• Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials. All activities occurring under your account are your responsibility.
• Account Security: You agree to provide accurate and complete account information. We reserve the right to suspend accounts that provide false data or violate security protocols.

4. Intellectual Property Rights

• Our Property: DREAMDIGITAL.AI LIMITED retains all rights, titles, and interests in the Service, including software, algorithms, proprietary models, and branding.
• User Input: You retain ownership of the data/prompts you input into the Service ("Input").
• AI Output: Subject to your compliance with these Terms, DREAMDIGITAL.AI LIMITED hereby assigns to you its interest in the content generated by the Service based on your Input ("Output"). You acknowledge that AI-generated content may not receive full intellectual property status and may not be protectable under some jurisdictions.
• License to Us: You grant DREAMDIGITAL.AI LIMITED a worldwide, royalty-free, perpetual license to use, host, and analyze your Input and Output to provide, maintain, and improve our AI models and services.

5. Prohibited Use

You agree not to use the Service to:

• Generate illegal, harmful, threatening, or defamatory content.
• Engage in "Deepfake" creation without consent or for any deceptive/fraudulent purposes.
• Reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of the Service.
• Use automated scripts to scrape data or overburden our infrastructure.
• Infringe upon the intellectual property rights or privacy rights of any third party.
• Use the Service to develop any AI models that compete with DREAMDIGITAL.AI LIMITED.

6. Disclaimers and Limitation of Liability

• 6.1 "As-Is" Basis: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• 6.2 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DREAMDIGITAL.AI LIMITED BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA.
• 6.3 Liability Cap: OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

7. Indemnification

You agree to indemnify and hold DREAMDIGITAL.AI LIMITED and its officers, directors, and employees harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

8. Governing Law and Dispute Resolution

• 8.1 Governing Law: These Terms and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales.
• 8.2 Binding Arbitration: Any dispute arising under these Terms shall be resolved through binding arbitration in London, United Kingdom, by a mutually agreed arbitrator, in accordance with the London Court of International Arbitration (LCIA) Rules.
• 8.3 Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

9. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, the Service's integrity, or our business interests.

10. Compliance and Export Control

You must comply with all applicable UK export control laws and sanctions. You represent that you are not located in a country subject to UK Government sanctions.

11. Changes to Terms

We may update these Terms periodically. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes. The "Last Updated" date at the top of this page will reflect the most recent revisions.
